The MSPB is a quasi-judicial and independent agency that provides “due process” to federal employees facing adverse actions, unacceptable performance plans, reductions in force, denials of within-grade increase, suitability determinations, restoration to duty issues, retirement benefit challenges, whistleblowing retaliation, discrimination based on military service (VEOA, USERRA), and other associated discrimination and retaliation issues.
A three-judge panel will present a half-day remote and interactive presentation covering agency charging considerations; best practices before the Board; and current controlling Board caselaw. In a full-circle session we will discuss what workplace issues look like before they become a case; what to expect if you are a party, agency defendant, or witness before the Board; and how caselaw from our appellate courts impacts your workplace environment. This session may be of interest to agency attorneys, HR representatives, agency union and management officials, and other federal employees wanting to learn more about the employment rights protected by the MSPB.
